Welcome to top-downinspections.com. These Terms and Conditions (“Terms”) are a set of legally binding terms defined by Top-Down Inspections LLC (“we,” “our,” or “us”). These Terms set forth the legal boundaries governing the activities of website visitors and customers while they engage with this website and our services.

1. Professional Standards & Compliance

We operate under strict professional guidelines to protect our clients and provide high-quality insights.

Florida Standards: All home inspections are conducted in accordance with the Florida Standards of Practice for Home Inspectors as defined in Chapter 61-30, Florida Administrative Code.
DBPR Rules: Our services strictly adhere to the professional regulations established by the Florida Department of Business and Professional Regulation (DBPR).
Non-Invasive Visual Inspection: Our reports are based on a visual, non-invasive examination of accessible systems and components at the time of the inspection only.

2. Website Use & User Eligibility

Eligibility: By using this website, you represent that you are at least 18 years of age and have the legal authority to enter into a binding agreement.
Account Suspension: We reserve the right to suspend or cancel a member’s account or access to our services at our sole discretion, without notice, for any conduct that violates these Terms.
Changes to Offering: We may, without prior notice, change our services, stop providing certain features, or create limits for the services we offer.

3. Payments and Billing

Payment Methods: We accept major credit cards and other secure payment methods through our PCI-DSS compliant platform. We also accept Cash or checks.
Billing Accuracy: You agree to provide current, complete, and accurate purchase and account information for all bookings made via our site.

4. Intellectual Property

The service and all materials therein, including software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, and audio/video recordings (the “Content”), are the exclusive property of Top-Down Inspections LLC. You may not sell, license, rent, or modify our Content without express written permission.

5. Limitation of Liability & Warranties

No Warranty: To the maximum extent permitted by Florida law, we provide our services "as is" without warranties of any kind, whether express or implied.
Liability Cap: In no event shall Top-Down Inspections LLC be liable for any indirect, punitive, incidental, or consequential damages. Our total liability is limited to the amount paid for the specific service provided, except for those cases where the client chooses the liability cap removal option for applicable and eligible services. At all times the signed contract by us and the client will be the only contract in place and enforceable. No other warranties expressed or implied will be valid if not in the signed contract.
Our Inspectors may be a part of InterNACHI's Buy-Back Guarantee program. Our clients understand that under the "We'll Buy Your Home Back" program, InterNACHI purchases the home, not the Inspector or Inspectors company. The Inspectors role is limited to his/he participation in the "We'll Buy Your Home Back" program, but InterNACHI purchases the home. Our clients understand that the inspector has no obligation to purchase the home under the "We'll Buy Your Home Back" program, and the clients sole remedy for any failure to purchase the home is against InterNACHI. more legal terms and limitations can be found at https://www.nachi.org/buy-legal.htm.

6. Privacy & Data Protection

Your use of this site is also governed by our Privacy Policy. We are committed to protecting your data in compliance with the Florida Digital Bill of Rights (FDBR) and the California Consumer Privacy Act (CCPA/CPRA).

7. Governing Law and Dispute Resolution

These Terms are governed by the internal substantive laws of the State of Florida. Any disputes shall be resolved through binding arbitration in the county of Polk, Florida where Top-Down Inspections LLC is based.
